You also agree, consent, and approve that we have full right and authority to market the products listed on the website on behalf of the sellers and can enter into any agreement or collaboration, or understanding with any marketing agency or any other agency on this behalf. • Solicits gambling or engages in any gambling activity which we, in our sole discretion, believe or could be construed as illegal.
• Contains video, photographs, or images of any other person(this includes minor or adult)
• Shall not post, or list any content which violates any provisions of law for the time being in force.

You consent and agree that it is your responsibility to keep the user ID and password secure and we will not be liable for loss, damage, or threats that occur to you. The user of this platform is restricted from transferring the account to a third person without informing us.

Prices

Prices of our products are subject to change without notice. We reserve the right to discontinue any service without any notice at any time. We will not be responsible to you or any third party for any price change, modification of services, suspension, or discontinuation of service.

While availing any of the payment method/s available on the Platform, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to:

• Lack of authorization for any transaction/s, or
• Exceeding the preset limit mutually agreed by You and between "Bank/s", or
• Any payment issues arising out of the transaction, or
• The decline of transaction for any other reason/s

All payments made against purchases on this platform shall be in Indian Rupees acceptable by the Reserve Bank of India. This platform will not authorize any other currency transactions.

Before shipping or delivering the order to you the seller may ask for identification proof from you(Government identification Id) to establish ownership of the payment instrument. This is done toensure a safe shopping experience.

You hereby agree and authorize us or our service providers to collect, process, or remit payments/ transactions via electronically or through Cash on Delivery to and from other Users in respect of transactions through Payment Facility. Your relationship with us is on a principal to principal basis and by accepting these Terms and Conditions you agree that we are an intermediary for all purposes, and do not have control of or liability for the products or services that are listed on this platform that are paid for by using the Payment Facility. We do not guarantee the identity of any User nor does it ensure that a Buyer or a Seller will complete a transaction.

You understand, accept, and agree that the payment facility provided by us is neither a banking nor financial service but is merely a facilitator providing an electronic, automated online electronic payment, receiving payment through cash on delivery, collection, and remittance facility for the Transactions on the platform using the existing authorized banking infrastructure and Credit Card payment gateway networks. Further, by providing a Payment Facility, we are neither acting as trustees nor acting in a fiduciary capacity with respect to the transaction or the transaction price.

You as a buyer are aware and agree that while initiating a transaction, you are entering a legally binding contract with the seller to purchase the product by using the payment facility and you shall pay the transaction price through Your issuing bank using the payment facility.

You as a buyer shall be entitled to claim a refund of the Transaction Price in case You do not receive the delivery within the period agreed in the Transaction or within the period as provided in the Policies, whichever is earlier. In case you do not raise a refund claim using Platform features within the stipulated time then this would make You ineligible for a refund.

A Buyer is entitled to a refund if the seller fails to deliver the product within the prescribed time mentioned in the order. We are not responsible to make any refund or any loss or damage that occurred to the Buyer.

If the buyer fails to make payment for cash on delivery transactions, we have full right to decline the future transactions with the concerned buyer or can blacklist the buyer. We as an intermediary shall not be responsible for the seller if a buyer declines to make payment on cash on delivery.

We will not be liable if there is a failure in the electronic payments made by a Buyer to a Seller.

For cash on delivery transactions refunds if any will be made through electronic payment transfers.

You as Seller hereby agree and consent that it is the sole responsibility of the seller to deliver the products on time, and in case of failure to deliver the product or any failure to comply with these terms and conditions or in case of the following circumstance, will attract a penalty of amount equivalent to our Commission and any other expenditure for processing the order

• Inability to meet the orders, due to the inadequacy of the product or otherwise
• Returns due to a bad or defective product
• Returns due to the wrong size of the product shipped or delivered by the seller
• Returns due to delivery of wrong products

You as a seller agree that in the above circumstances an amount equivalent to our Commission and any other expenditure for processing the order as a penalty shall be transferred by us to the concerned buyer. Any balance amount shall be transferred to our account for processing or other expenditure connected with the order.

We reserve the right to change the penalty amount at any time without informing the seller.

Products or services

Certain products or services are available through our website only. Some products or services may have limited quantities and are subject to our return and exchange policy.

We have full right and discretion to limit or restrict the sale to any particular geographical region or jurisdiction.

You as seller are responsible for payment of various taxes applicable to you and file all returns and other taxation compliances applicable under various state and central tax laws.

We reserve the right to examine, study, check quality parameters and verify the product before listing it on this platform. The seller agrees that we have full authority to reject any product to list on this platform without informing the Seller.

You, as seller responsible for the following, when you list your product on this platform

• Quality of the product
• The authenticity of the product
• Any damage to the product
• Accuracy of the information regarding the product
• To update information regarding the availability or non-availability of the product on the platform
• Any other features of the product

Accuracy of billing and account information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. The seller shall not sub-contract any of its rights, obligations, or responsibilities under the terms and conditions without our prior written consent.

Severability

If any term of this Agreement is adjudicated to be invalid, illegal, or unenforceable by any court of competent jurisdiction, such adjudication shall not affect any other term of this agreement. The remainder of the terms and conditions shall continue to be in force and the respective rights and obligations of the parties or users of this platform shall be construed, enforced, and adjusted accordingly. The parties or users of this platform shall make efforts to modify the invalid term to the extent necessary to render such term valid, legal, and enforceable, if possible.

Waiver

If any party or user of this platform fails to perform its rights under the terms and conditions, will not be considered as a waiver of that party's or user's rights. Following are some indicative examples of potential disputes

In case if the seller is not able to provide a refund or replacement, the Buyer can write to us atContact@artiztick.com, we will act as a mediator between the Buyer and a Seller. Facilitating mediation doesn't amount to any guarantee of any refund or replacement.

Raising a dispute against the seller does not create an automatic refund or replacement to the Buyers.

M/s Daskan Technologies Private Limited does not provide any guarantee or warranty for the products sold on this platform.

Please note that once a Buyer raises a dispute with us, the payment for the seller for the related product will be put on hold.

Use of the platform

These terms and conditions act as a binding agreement between the user of this platform and us.

We reserve the right to make changes in the terms and conditions with prior information or intimation to the seller.

You are not authorized to make any changes of contents or information.

The seller has the full right and authority to share the linkhttps://artiztick.com/ in any digital media platform to market or promote their products or services.

It is the responsibility of the seller to periodically review the terms and conditions for any updates and we are not liable for any loss or damage that occurred to you due to the inability to read the terms and conditions.
